Divorce with in a year of marriage

11-May-2023 (In Divorce Law)
I got married in june'18. One the very first day my husband forced me for oral sex & did all things (except intercourse) without my consent. After which I went to mental depression as it's an arrange marriage & I cannot discuss these issues with anyone in my family. When we went for trip over there he admitted that for him marriage means Sex & that's more imp than anything else. Due to his behaviour I got afraid if him. When came back he discussed all the things with his Mom & humiliated me infront of all the family members. Even though things like when we should do n how long should be do it's being decided by his mother. After that things got worse between us when his mother started taunting me for money which my mother didn't give at the time of marriage. His family is fully orthodox which believe husband is you God be it bad or good & I should obey him always like slave. Finally I left house on 7oct now wanted to knw how to filecase in my favour. In their papers all blame is put on

A wife can file a case against her husband for unnatural sexual offences under section 377 of IPC. As the section punishes sexual intercourse against the order of nature irrespective of the sexual orientation or gender identity of the individuals, thus even if such acts are done by heterosexual couples; they can be punished under section 377. Further even if the victim consented (irrespective of the age) to the act then also the offender can be punished under this section. The consent is immaterial for the application of section 377 and an unlawful act cannot be legitimized by the consent of the victim.

Hello ma'am. I have perused your query. You can proceed under the DV act and seek a residence order in addition to one for interim maintenance. You can also file a criminal complaint under s 498A. In case you wish to file for divorce you can always proceed under the grounds of cruelty. Please feel free to reach out to me in case you wish to discuss the matter in more detail.

you have to clarify what do you mean by "their paper". you have various options and rights which you can exercise, both civil and criminal. at the same time, you can apply for divorce, if you want to go ahead with that.
