Divorce on grounds of mental cruelity

28-Oct-2023 (In Divorce Law)
My sister's husband has filled a divorce case on my sis in grounds of mental cruelity, marriage happened on June 2017, after that they started torturing her. They targeted her salary as she is working. Thrown unrealistic demands on her, used abusive languages and tarnished her image in her office also by defaming her. She came to us for a ritual and they never came to take her back, instead waited for 1 year to pass and filed a divorce case in the court. I am her brother, we lost our father in 22 yrs back, my mom is mentally challebged, I don't have time to fight out in courts plz suggest best possible remedy under my circumstances.

Hi,

In this regard.

You have two options. Your sister can either consider entering into a 'Divorce by Mutual Consent', both parties will be bound down by the Consent agreement and the return of any valuables that were provided during marriage can be negotiated, or also if any maintenance is to be paid. However, since only a year has elapsed since the marriage, the opposite party might not be inclined to pay any maintenance. It depends from circumstance to circumstance, or whether if your sister wants to seek maintenance from her husband.

Do let me know if you need clarifications.

sorry to hear about the state of affairs at your house. as per your query, the best legal recourse for you is to file a police complaint. she has a right to live in that house since it is her matrimonial house. so you can go to the nearest police station and take them along to her matrimonial house and tell them that she wants to stay there.
