Well, first of all, you need to send a Legal Notice to your Husband asking him for Divorce, as it needs to go on record, if he refuses to Divorce you, then, you will not be able to take Mutual Divorce, but can apply for Unilateral Divorce on certain grounds!

If both you and your husband are consenting to a divorce then you can opt for the same. As far as expenses are concerned, you must first try through family, else go for notice. Feel free to contact me for seeking any legal advice/assistance as regards the same.

You need to file proceedings for divorce simultaneously you need to apply for maintenance for yourself and children's if any. Furthermore you can seek protection from the court under the domestic violence act and also seek accommodation from him. You can also file a complaint for harassment under the Bhartiya nyaay Sanhita.

You can file a maintenance application in the Family Court. Your case will need to be assessed based on the specific issues in your marriage. If he still refuses to pay despite notice or attempts at a family settlement, approaching the court would be the most effective way to secure maintenance or alimony.

If you want a divorce and also wish to claim compensation for your mental, emotional, and financial losses, it's best to send a legal notice through an advocate. Mention your intent to file for divorce and include your demand for compensation. This formal step protects your rights and sets the legal process in motion. Avoid informal talks through family, as they lack legal standing.
