Divorce - married under Arya Samaj rites
03-Apr-2023 (In Divorce Law)
I am an American citizen and I got married in India under the Arya Samaj Mandir rites in New Delhi. I am older than my husband. His family are making lots of financial demands which I cannot meet. They are holding our marriage hostage by forcing my husband into a second marriage as a punishment to me for not meeting their financial request. It's an ongoing fight to convince my husband against his mother's emotional blackmailing tears.
Back in October, my husband had mentioned that he's is having sex af with someone else and wants to marry her but because he's always joking I did not pay attention to his words but in January, 2019, I have seen and felt his hatred and anger.
I am tired of trying to fight to save our marriage that was ended 4 months after it was solemnized. Please give me your guidance on how I can file for a divorce and will that divorce be considered legal since we got married in India. Your response is greatly appreciated. Thank you, Kushum

Dear Client,
Once you have been married by ARYA SAMAJ rituals, which provides marriage certificate ,if you have such proof then you can file Divorce. But here you have not mentioned your date of marriage performance.
If it has passed 1year then you can oot for Divorce and Dowry Act.
If he is also wants divorce then you both can opt for Mutual Divorce before court with one petition.
you can consult me for the same fr9m this platform and discuss legal points for your needful legal way out.
Thanks

the easiest way for you to get speedy divorce is by filing mutual divorce petition in Delhi itself with the consent and on mutual terms decide between you and your husband. after filing mutual divorce petition you just have to reach Court only for 2 hearings and you will get decree of divorce from the court .
Hi,
Reading through your query it seems your husbands family is more interested in your money.
Anyways, this is very common in practice in certain parts of India.
If your husband is not keen to give you a divorce then it will be a contested divorce. Further, consultations shall be required as it maybe not be a straightforward divorce case.
Please feel free to consult me.
