Divorce, maintenance, dv cases

19-Aug-2023 (In Divorce Law)
My daughter left from her matrimonial home as harrassed by husband and in laws. Also marriage was non conumated since 5 years. Now she is living with her uncle. Can she file cases from her uncle's home without any address proofs. Also her husband sent summon u/s 9. Does that necessary to attend the hearing u/s 9. Or any legal reply to be sent.

Hello Sir/Madam, First of all, if the husband has filed petition U/s 9 HMA, please attend the court proceedings once summons are received. In your absence some adverse order can be passed too. Moving ahead, yes she can file cases from where she is residing. Please call for further clarification Thanks Adv Dr Preeti

It is necessary to appear before court or if she doesn't want to appear than she must hire an advocate who can handle the matter and also necessary to contest the matter if you never appeared in court after receiving of Summon than her husband get benefit from this and get a ex parte decree in his favour.. firstly the time when she left her matrimonial home she could have filed a case for domestic violence and could have seek maintenance as her right. similarly she can file the case from her Uncle's home having regards to the address if she can showcase that she been living with her uncle since long. futher more she needs to appear in the court and justify. the stand she is relaying upon. to seek further help you can call.
