Dear Client
You can file a petition for mutual divorce either where you last resided together as husband and wife, where the wife resides or where the marriage was solemnized. Your marriage is valid and can be filed at either UP or Haryana/Delhi depending on where you were last living together. It is however only a procedural issue and cant be resolved. You may contact for filing of a divorce petition.

Hi,
Yes, your marriage is legally valid. You will have to proceed to file a petition for Divorce by "mutual consent'. Through this, both you and your husband will have to appear before Court and state your reasons for separation. There will be two hearings in the matter. The first hearing both parties will appear and the second will be after 6 months where divorce shall be granted.
