Divorce due to wife's infidelity

Dear sir/madam, I am married from last 7+ years and have a 6 year old son. Mine was a love marriage. Few months back I discovered that my wife chats with one of her male friends a lot but she told me that they are just friends. But 3 4 months back I saw some messages which pointed that they were more than friends. So I spied her WhatsApp and few days back I found her chatting with her BF. They were doing phone sex. I took screenshots of all the messages as a proof. On confronting she admitted that it was a mistake.Now I want divorce from her on the grounds of infidelity. Moreover She is good for nothing. She does not take care if household chores, the kid or me. She also suffers from a mental disorder called OSD and is currently on medication. My sex life is in a bad shape and we get intimate once in 2 3 months Please advise 1. Can I get divorce on the basis of wife's infidelity 2. Do I need to pay alimony and maintenance. She is a working lady 3. Who would we responsible for the

First if mental disorder permanent and cannot be cure. Secondly she has recourses to protect herself financial and medical. Third if she or you filed a case u have to pay maintenance or interim it's depends on circutances and evidence u have against her.

You can seek the divorce on the grounds alleged in the facts of your case . Since your wife is involved in an illicit affair you can validly apply for the divorce on the ground of the cruelty and seek the divorce ans you can also avoid the maintenance by showing the evidence that she was in an illicit relationships.

Yes you can take divorce by filing divorce case before the competent court. This is valid ground for divorce. If your wife is working, then you have not to pay maintainance. You have to pay stridhan. But you have to give maintainance to your son. It is better to settle the matter amicably. If not then file a divorce case.

The incidents which you are telling are the grounds of divorce but it will fall under cruelty. Another thing is that if you take OSD as ground of divorce, then you have to prove that the illness is not curable and her illness affect you and your son very badly. Revert me. All the best.

Prima-facie yes you can file divorce case on the ground of infidelity and others but getting divorce is a little different unless you prove the same in accordance with law. Regarding maintenance and alimony etc.you may not required to pay for the same depending upon various other factors for need to know some more information and facts.
