Disclose of US assests in DV case

03-Jul-2025 (In Divorce Law)
Hi, I am an NRI living in USA and undergoing matrimonal dispute with my wife who has filed DV case against me. Court is asking me to declare all assests and liabilities. I was wondering if Indian court can get my US bank details. I don't want to disclose all the assests to avoid potentially high maintenance amount. At the same time, I don't want to face perjury case incase opposing party finds out my bank accounts. Is it safe to not disclose all the US assests in this case?

As per the supreme court ruling a person claiming maintenance and from whom the maintenance is claimed both have o disclose their assets and liabilities before the court. Your wife might be knowing all the details of the assets and liabilities owned by you in India and in US it is not advisable to hide anything from the court which may later be disclosed by your wife. report mein take any adverse inference if the same is later been brought to the knowledge of the court. However the details of assets which your wife can not prove before the court that can be taken care off.

Yes, it is mandatory for an NRI to disclose US assets in an Indian court affidavit if ordered to do so in a Domestic Violence (DV) case, regardless of standard tax disclosure rules. While NRIs are generally exempt from disclosing foreign assets to Indian tax authorities (unless claiming refunds or receiving Indian income abroad), a court Non-compliance with a judicial directive can lead to contempt of court, fines, or adverse inferences (e.g : assumptions of hidden assets.)
