Child Visitation who is abroad

09-Feb-2025 (In Divorce Law)
My wife has filed for divorce in India and canceled my UK-dependent visa, requiring me to return to India. My son is 1.5 years old, and I haven't seen him in a year. Could you please advise on the fastest way to see him and check on his well-being?

You should file a Writ Petition in the court, which will be directed for a visit twice a year. This is to ensure that you have a clear understanding of the matter. If you wish to arrange a consultation, I will provide you with a detailed explanation.

Your wife has filed a divorce case, so you should appear in the case. If you want to keep your child with you, file a custody case under the Guardianship Act. To obtain custody of your child, submit documents related to your income source in court. Based on these documents, the court will issue a decree and grant you custody of your child.
