Child custody of a new born baby when husband is abusive

03-Feb-2025 (In Divorce Law)
I m a mother of a newborn, my husband and his parents have not treated me well since our marriage in Nov'21 They have a very controlling nature and I have tried to adjust as much as I can without wanting to lose my individuality, but they have never stopped taunting or stopped trying to control me because of which the relationship has never flourished. They don't like me, I don't like them but the problem is that now since I have given birth to a baby, my husband hands over the baby to them

As a mother, you are natural guardian. You can take custody of your child. it is your statutory rights. A mother can take custody of child till five years, Guaranteed. after this, you have to proof that child's future is very good at your hands.

Gone through your problem, you can approach Hon'ble High Court to get the custody of your new born child but before doing so we need to know the age of baby means breastfeeding or 2-3 years old. Is there any case is pending in any court against your husband or in-laws. For more detail discussion you can make your query on whatsapp or call on phone.
