Can I get separation from my husband without divorce

I got married 5month before. He & his family me torturing me mentally and physically. So I want separation from him and do I get maintenance from him.

Hello, Totally understandable that you are being harassed by your in laws and husband. Maam, file a complaint in nearest Police Station. Going ahead, file a case for Maintenance under Hindu Law And Domestic Violence under Domestic violence Act. Yes, you can certainly get judicial separation from your husband without getting divorced. Additionally, you are eligible for the maintenance under the provisions of the Criminal Procedure Code as well as the Domestic Violence Act in the aforesaid circumstances.

yes u can file maintenance case on your husban and he have to pay monthly maintenance in court and if his family torturing u mentally and physically u can also file domestic volience case against them and u have also options of dowery case.

yes you can get live separately with out your husband. in that case you get maintenance from your husband on the ground of cruality and you can also put in your petition that the both of the parties didn't live together because misunderstanding and miss behaviour of the familys. and one more thing if you file maintenance you must have income proof of your husband and also you doesn't do anything for your survival miss you have no income to maintain yourself.

Yes offcourse you have all rights to live seprate from him he is liable to provide you seprate rented house and also liable to give you maintainance as per capacity, you can also get a share in his house and can live in same house if you want, you can also file judicial separation petition under section 10 of Hindu marriage act and also get protection from police as per domestic violence act and you have many more rights.
