Can a person remarry without divorce if wife ran away 10 yrs ago

I am experiencing domestic violence at my home. I am not in a good condition. My parents are torchering me. I want to marry a person who was married 10 years ago and his wife ran away, so there was no divorce. How can we be legally married ?
Dear mam,
If you want to marry that person then tell him for give divorce to her wife legally. And file divorce u/s 13 i-b.
If she will not appear in court, in this situation the court will gives ex-party divorce decree .
