Alimony maintenance property right related issues

I am Hindu married woman, due to harassment of my husband, I have made FIR under section 498a against my husband and family. My husband is now not giving any money to me and for my child . I am ready for mutual divorce with alimony but he not agree. He is a government servent and having Flat on his name in Mumbai. Wheather I should file divorce case or not. Present I am staying with my parents from last 50 days. What to do to get maximum alimony from husband. Please help me.

do proper pairvi in your 498A case and along with that you may file 125CrPC and 12 DV against your husband and in laws. if you want divorce you may also file the same before competent court of your jurisdiction.

you need to file a maintenance case or file a domestic violence case against your husband and demanding maximum maintenance. after that your husband come in pressure and may be come to compromise for mutual. but you never file a divorce from your side.

माननीय न्यायालय के समक्ष तलाक तभी लिया जा सकता जब दोनों पक्ष अपनी सहमति दे और उन शतों लिखित में कोर्ट के अंदर दाखिल करनी चाहिए उसके बाद ही कोर्ट उसे पर म्युचुअल डायवोर्स दे सकता है। उसके लिए सबसे पहले आप एक अच्छे विशेषज्ञ एक्सपर्ट एडवोकेट से जरूर संपर्क करें।

You should immediately file an application for maintenance under section 125 of CRPC or under section 144 of BNSS. At least you will start to get some money from your husband which will help you maintain yourself and your child. Your husband cannot deny you the right to maintenance and the court is likely to grant maintenance to you. If you require advice on further course of action, please contact me. Thank you.
