I hindu women stayed with my husband and inlaws for 6 months .they use to abuse me hence I left and started working in a different city .since then last 10 months my husband is giving suicide threat that If I am not coming back and working according to their wish he will take poison etc and sending me text of these.i dont want to go back.I want to file contested divorce. If he does a suicide or take any step will I be in trouble regarding the same. Please suggest .As I am working but less amount can I get any alimony bcos stayed there for only 6 months .
If your husband filed divorce against you within 2 years of your marriage then his suit will not maintainable. only after elapsed of 2 years he can eligible to file a divorce suit or both of you can mutually filed divorce. so dont worry if you are not agged to divorce at this momnet he cant file. there are several rullings to defend your matter.
firstly it is important to understand the technicality of law or how the law works, if you are being abused and tortured, do you have evidence for the same, if you do not have the same create it, your homework should be perfect, thereafter filing of contested divorce is not a matter to be considered now, it may take 5 years or may be more to end, your husband is giving suicide lodge a complaint at this stage, you will surely get added advantage at a later stage, it is the discretion of judge whether you will get alimony or not but there are judgements that you may get

What I can advice you is that you can lodge an FIR Primarily under section 498A and also file separate Domestic Violence cases against your husband and inlaws and later on file a divorce case against him. This should be the proper course of law against him. Let me know if you need more assistance.
