125 by wife and divorce by husband
10-Dec-2023 (In Divorce Law)
1. Husband filed divorce in Nov 2017. Now the case is scheduled for petitioners evidence in Feb 2019. What application can I file to delay the case at this point. Can I file reply to rejoinder as I have evidence regarding recent developments.
2. Husband has filed application for appointment of court commissioner for recording of evidence saying his parents are Sr citizens. Does this means we cannot do cross? On what grounds can I oppose it?
3. 125 filed by wife in Oct 2017. Interim not decided yet. How can I fast track the case? Is it a good move to file hma24 after 125? Hma24 not filed yet. Can 125 be dismissed on the grounds order already passed in hma24
In this regard, i advice you that there are numerous application depending upon the facts of the case to delay the proceedings and most importantly in your case there is no interim maintenance which has been awarded to you please press for the maintenance in the said matter and get the same from the date of filling the said petition. There is basic points you need to keep in mind, as the other side is rushing his case and your win is to get monthly maintenance, residence and other expenditure for you minor/s and delay the proceedings. Then only one will come to table for settlement. For further clarifications, please contact.
Hi mam,
As per your legal query, you should definitely file 24 HMA before the Hon'ble court where divorce petition is pending. Further, you should strongly press for disposal of your interim application under 125 petition as well.
For rest of the query, I would like to see the documents and inspect the judicial file.
