23-Apr-2024 (In Criminal Law)
My wife filed a fir with sections 498A, 494, 323,34,504 and 506. Will police arrest me with these sections?
Hello when it comes to 498A or any offence which is punishable upto 3 years of punishment, police may arrest but it depends on allegations and seriousness of case, they will issue notice under sec 41A of CrPC to co operate for investigation it is always advisable to apply for anticipatory bail
Section 498A is a cognizable offense. You’ll have to immediately apply for anticipatory bail from the court of session in order to secure yourself from the arrest.

Well, If FIR gets lodged under Sec 498A against you, then, legally Police has to serve upon you Sec 41A of the CRPC,1973 first to invite you to co operate in the Investigation. If Police arrests you without serving Sec 41A of CRPC, 1973, after lodging of FIR, then, it has to state satisfactory reasons for the same. If Court won't get convinced or satisfied with their reasons for not serving upon you Sec 41A CRPC, 1973 first, then, arrest made by them will be termed as illegal and as such, Court will release you.
