My father-in-law died more than 15 years back. He did not leave any will for his flat in Malad. His wife and one son stay in that flat even today. He was survived by his wife, 2 sons and a daughter ( my wife). The society (CHS) transferred the shares to my mother-in-laws name. Now she wants to transfer the shares to her younger son, who lives with her, as the elder son is disconnected and lives elsewhere since a long time in Mumbai, her daughter does not want any share. Now, she executed a registered gift deed for her younger son, who lives with her. Question is, weather the property can be transferred by society to younger son's name and can the elder son challenge the gifting.Please respond.

The gift deed is invalid cause she’s is only trustee of the property and trustee always bound to deliver share to legal heirs, the property canot be transfer unless & until there’s a executor appointed of property by the court.
