You’ve to immediately make complaint before the deputy registrar of co-operative society against the society & neighbors for restricting your rights and simultaneously written complaint via legal notice to near by police station which comes under the jurisdiction of your area

Q: Transfer of title after demise of father to sibling

My father-in-law died more than 15 years back. He did not leave any will for his flat in Malad. His wife and one son stay in that flat even today. He was survived by his wife, 2 sons and a daughter ( my wife). The society (CHS) transferred the shares to my mother-in-laws name. Now she wants to transfer the shares to her younger son, who lives with her, as the elder son is disconnected and lives elsewhere since a long time in Mumbai, her daughter does not want any share. Now, she executed a registered gift deed for her younger son, who lives with her. Question is, weather the property can be transferred by society to younger son's name and can the elder son challenge the gifting.Please respond.

The gift deed is invalid cause she’s is only trustee of the property and trustee always bound to deliver share to legal heirs, the property canot be transfer unless & until there’s a executor appointed of property by the court.

Q: Delayed possession of plot in Ensara City Township Nagpur

Sir, I want to know what action will I take now. My plot is under RERA Registration and their manager promised me to complete work till december 2019 and handover me my plot.I made full payment and registry.

The most ideal remedy is file a specific performance suit in the civil court. If you go to Rera he’ll take the defence of Force Majeure and you’ll be helpless and without a remedy. Even if you succeed he can go into appeal and the Rera appellate tribunal will take time to decide.

Q: My father's property that I want to give my sister

Hello,Recently my father Passed away and now in property card there is my name, my mother and sister name. But now I don't want anything from my father's property and want give it to my mother and sister. So how will I able to do it. Do I need NOC or anything else. I have no idea.
