Will anticipatory bail be granted if interim relief is given in 376

Hi allMy friend has been accused in a false FIR done by an educated lady of age 39 who is MD doctor. She used to travel to meet him and she used to book tickets also for hotel rooms in different places of India. She also admitted in the court that she used to come to the boys room regularly on her own and did romance. All of this while he was fighting divorce case which she knew and also knew that he cant give promise to marry. nnNow post his divorce they met and had relationship and now after 7 months of no contact she filed a fake 376 case.

If there is a delay of 7 months from last sexual intercouse between them then the prosecutrix will not be able to prove the allegation of rape as there will b no evidence of sexual activity in the medical report. if u are sure that this is a false case and have proof in this regard then u should approach HIGH COURT for quashing the FIR and all proceeding Under Section 482 crpc.

Hello if interim releif is granted in anticipatory bail and your friend comply with the directions of the Court there are good chances that the anticipatory bail will be made absolute and he will get bail thereafter case will be decided on the merits of the case after going through trial.

In the particular given scenario the person needs to appear in court as the court would have summoned him. And in accordance with the existing status of law he has to fight the matter and there are strong chances of him to win if things would be done in a certain manner.
