Dear Client

An offence under section 354D is bailable (on the first instance). In such a conspectus, the Investigating Office / the officer in charge can grant bail on personal bond. Such is so in case there are no other serious offences that the FIR is lodged under.

Feel free to get in touch for further discussions.

first of all 354 D is the offence of stalking and yes if a person is arrested for 354D..he can be granted bail but still when the trial continues against him..it will continue in any magistrate court. also if he is punished for the first time..he can be punished for max 3 years and second time for max 5 years

The person concerned is eligible to get bail from the competent court of jurisdiction. You need to approach the competent court only with all your favorable evidence/ documents and all the facts which can help you get bail. It is a fundamental right to live with dignity, freely and speedy justice.
