Regarding Omission to ACT which commence criminal offence.

that in a case where operator has not taken backup on three respected dates which should be ensure and taken by the supervisor and he ordered to operator. in this case polish made accused to operator for criminal misconduct but for supervisor police said it was a negligence. then I want to know how can we save operator because an act of omission and commission which is negligence for one can not be criminal offence for another. guide me.
