Pranam sir, an FIR lodge against my whole family under 420,34ipc,3/4 dowry prohibition act...my name was also there.... We settled with the opposite party in lower court. chargesheet also sent to the lower court still trail & judgement pending ... recently I'm selected in Excise duty group c post......we lodged 482crpc quashing of FIR with the ground of compromise but opposite party do not ready to come in HC ..what should I do...pls help me as soon as possible I'm totally depressed & my advocate do not consider... thank you ❤️

First of all Depression will not do anything. If there was a settlement seed that was signed by both the parties then the opposite party should come. If they are not coming you can always file the quashing under merits and then the judge will give them a notice to appear before the court.

You have not mentioned the details of settlement details. Whereas, section 420 ipc is compoundable with the permission of the trail court. If there is any settlement then u must do the settlement execution on the condition of quashing the FIR u/s 482 CrPC …need more facts on your case !

In the above circumstances 1. you have any copy related compromise then show to your department and withdraw you name from that case. 2 withdrawal can be done at any time after filling taken on board application you complete your procedure in lower court.

The High Court under Section 482 has the power to quash an FIR even after filing of Charge Sheet by the prosecution. The parties can also reach a modus vivendi. The accused can also appraise the Court that there is no material evidence against him even after the investigation in the matter.

sir quash of fir is possible. the lower court had not completed the entire proceedings in. time. a separate case has to be filled for honorable acquittal discharge case also to be filled. so it is possible

send her a legal notice calling upon them to come forward and cooperate in the formalities of closing the fir on the basis of the compromise already agreed. this is unjust! once they have agreed to the compromise, they are bound by it (the compromise)

Dear Questionnaire As per the law you have to comply the direction of the court. Sometimes court call to party to appear before court in compromise matter for listing his/ her stand. You persuade to appear before court for closing of case.
