legal remedy for bank account frozen by CBI

Can a prompt resolution be given by the courts on frozen account by dint of necessity to run the family. if yes, then under which section/code/law/article/regulation ; if no, the what could be done?

You have to file application for de-freezing the back account. As per the various judgements of the Supreme Court and High Courts, only the amount alleged in the crime can be freezed by the agency and not the entire account. Further, if there is no crime involved, the entire account can also be de-freezed. You may contact for further consultation.

You have to make an application before the concerned CMM court asking for unfreezing your account. He will direct the IO of the case to submit status report . On hearing IO submissions the CMM will make an order. application should be under 457 CRPC

sir it is under Article 21 of the constitution read with article 226 of the constitution, take a order from the honorable High Court, immediately withdraw money from your account, high court have power under article 226, HC respect the right of the citizen under article 21 of the constitution. there are sections under CRPC

there is no any law which can help you to unlock you back account till the time investigation is pending. only thing is you can apply to the concerned judge for unlocking you can with all relevant documents which provide you innocent than judge may allow

Depends on variables circumstance like whether you are named accused in FIR on not, or any proceed of crime has entered into your account, then refer the notice you have received. Based on this Rouse avenue court has to be approached thereafter High Court.
