Q: Property deal with two Property deslers

Signed unregistered sale agreement with builder 6 years back and took token amount he has not paid balance amount.Signed mou with another builder 6 months back and took token amount.Now we want to cancel at least one agreement. Pl advise which one is easier to cancel if we return double token amount.

Cancel the second agreement bcz even if the first wants to file a civil suit for recovery of money it would be time barred as per Indian limitations act and he has no remedy left in law . Cancel the second one

You can file a civil suit for permanent and ad interim mandatory injunction in the civil court of your area describing how this play school is creating non sense and court will also see if it is duly approved from MCD and then pass a stay order accordingly

since the court has removed her name , your sister can file a case for defamation & malicious prosecution against your wife but you must have proof that your wife made false allegations in police complaint

Q: To ensure that my girl child is not completely taken away from me

Hi,We got divorced in mutually in 2023. I was forced to agree to terms of mutual divorce due to FIR in 498A. I was in Gurgaon at that time now in Delhi. Additional cases of Divorce, Maintenance were in karnal court. Now my ex wife is getting remarried. How can I get my girl child of almost 8 years with me? I had to reluctantly agree that I will not ask for child custody in future at time of divorce. B) No visitation rights mentioned in decree though I am meeting my child twice a month.

You can still file a custody petition under section 7 despite condition in mutual divorce. since your wife is remarrying you can argue for change in circumstances. If full custody is a problem then you can at least achieve joint custody.

Q: Owner of property , register gift deed (property gifted me by mom)

I am the absolute owner of property but son of my brother creating unnecessary trouble in my possession, I want restraint order against them . Is it possible to get restraint order very soon.

Since you are the absolute owner you can file a civil suit for permanent and mandatory injunction along with the application for ad interim injunction for immediate relief against them . if they are threating posession then you can file a complaint under section 145 erstwhile crpc
