Indian citizen's rights, arrested in false posco case

02-Aug-2023 (In Criminal Law)
My husband is arrested in false posco case made by police. Actually the victim has written the fir on "a person" and some unidentified people. Police arrested my husband as one of those unidentified people. But my husband is innocent, even the victim has said that my husband is innocent in front of district court. But the police has made the false report. Now the case is in high court and police is delaying the process by not sending the charge sheet of the case in the High Court.

As you have told that a case has been registered by a victim girl against your husband and any other unknown person whose name and address I do not even know the identity under POSCO, but the victim does not even recognize your husband, then your husband is innocent. Even in the court yet not chargesheet by the policehas been sentYou have not mentioned in your problem that your husband has not got bail yet and probably no case has gone to the High Court, don't know that your husband may have gone to the High Court under the rate of 226, then the police would have sent charge sheet. She sends it in about two-three months, there is no interference of the court in this

If the victim who alleges to be less than 18 years of age & she has vituparitivly & sccurilously tarnished the image if your husband, your husband has liberty to get medical examination of the minor accessing your husband for such aghast incident. Responding to your second part a notice exigently has to be send to the concerned police officer asking them as to why the chargesheet has not been sent to the court in such heneous incident. The high court here will after the unambiguous description of the facts either commit the matter for re- trial or will pass a judgement or order therein
