CRIMINAL MISC. BAIL APPLICATION

07-May-2023 (In Criminal Law)
In my case ,there are number of applicants , from those two bails had been rejected in other court , one has been approved by other , I am the one who is innocent and applied for bail. Learned A.A.G is personally taking interest in this case and not letting us to move forward or getting bail. Learned A.A.G has file a counter against us and didn't provide the copy of it as he said that you will get the copy at the time of hearing date only . Is this legal ? My applicant is itself a advocate but has been framed by someone . It's been five months since applicant is in jail . The bail is easy but learned A.A.G is getting into this . I don't know what to do and how to make it possible.

Dear Client, I am not able to understand your query though but i suppose the you are concerned whether the counter has been filed by the Government counsel or not. So let me just brief you the counter can only be filed only once the copy will be served. Regards

a case can be filed for bail in cas there is an urgency. the bench has to be convinced that the matter requires urgent hearing. therefore if there is an urgency you should file the bail application. regards

you can simply ask your advocate to inquire about the counter affidavit in the state office as the counter affidavit cannot be filed in the court without getting the receiving from the council for the petitioner
