Cheque and Cash payment for purchase of agree land

I have made payment of 40 lakh to a person for purchase of agree land over span of three year out of which 1300000 through cheese and RTGS and reaming through cash, I have cash receipt of above with sign on revenue stamp, I have also taken promissory notes of above transaction on his letter head with his thumb impression, after this he cheated with me and deny fir sake deed giving false reason, after putting pressure he agree to refund and given me the change against above payment with his sign and amt but not deposited the cash in his bank account and asking me to wait further killing my time, what way I can utilize to get my hard earned money back 138/ 1, forgery , Fraud whit I can opt to get money back Pls suggest fast and guaranteed way to recover money and

If you want the land then in that case you can file suit for specific performance. If you want your money back then you will have to file suit for recovery of the amount. If he has given you cheque which have bounced the case under sec. 138 Negotiable Instrument Act can be filed along with suit for recovery of the cheque amount. A criminal case by registering a FIR at police station can be filed. These are the remedies available. Any of these can be opted for.
