can seconf FIR be filed in same case
08-Dec-2023 (In Criminal Law)
i have read that a second FIR is permissible only when it is in the nature of counter FIR . But I want to know that where a second FIR is not a counter FIR is that FIR legal?
suppose A murdered B in a hotel owned by Mr. C , a FIR was lodged against A under section 302 by B's family and after a few days C lodged another FIR against A that when A murdered B he has also caused hurt to him and stolen property from his hotel.
Here the FIR by C is not a counter FIR but a FIR against the same person(A) setting out different allegations out of the same act .
Is the FIR lodged by C legal?
