Q: FIR under both IPC and IT ACT, is it valid?

Hello respected members, an FIR is filed by police under section 419, 420, 120B, 66C and 66D of IT Act (CASE RELATES TO DATA THEFT ONLINE) but as per recent judgement by Bombay high court in a similar case had said, prosecution under both IPC and IT act violates the rule of DOUBLE JEOPARDY and Bombay high court quashed the FIR as far as it related to IPC. nCan we take that judgement of Bombay high court as basis to get the case quashed for sections under IPC? if yes, what is the procedure? Should we go to high court or can trial court do this? And, Is plea bargain possible in cases related to IT act?nnAlso, is there any lawyer here who deals in these cases? I need an advocate in Delhi. Please share your contact details.

No its not at all valid….When special act is involved it supersedes Indian Penal Code.Its not about double jeopardy but accused cant be charged under both the acts that is one special act and other Indian Penal Code



Q: Do I need bail when I'm in column 12 in chargesheet?

My neighbour attacked a lady who filed an FIR and put my name also that I abused her verbally. There are video cameras and I have proof that I wasn't talking to her at all. Police has put charges (354B, 354, 323, 34, 509) on my neighbour and put me in column 12.I have seen the chargesheet and my name is in column 12 by police due to lack of evidence.However, I've received the summon from court. Why might that be? Will I need to get bail despite not having any charges on me?

As the offence is heinous and i would recommend to get the anticipatory bail. It will be better for you.And if you got summon from the court then there is very bright possibility that against you also Cognisance was taken by the court.

No… wo chahe apna poora zor lagale agar apko divorce nahi dena to wo divorce nahi le payenge at any cost.If you do not want to give divorce to your husband then your husband will not be able to take divorce from you.

I have a a matrimonial dispute going on. My wife try to invade my brother's house against which we have a police complaint. I have filed a defamation case against my wife and in laws.Can I obtain a restraining order against my wife and in laws forbidding any contact with me, my family or my workplace?

Yes you can get restraining order against your wife and in laws.Family courts have jurisdiction to entertain these types of cases and restraining order can be granted on urgent basis through interim applications.

Avi Mai bail pe hu..aurat ki Umar ab 39 year he or Meri 28 year he.ky mujhe shadi Kar Leni chaye ya Mai case fight karu. Ky Mai is case se bhar aa sakta hu.

fight case ..because false promise of marriage is not rape....there are lots of judgements which clearly says that it is not an offence as girl is not naive and well educated and knows ehat is correct for her and what is wrong.so go on fight the case and it will be in your favour.
