Regarding to your query bail is a descreation power of court. The court can give or not give bail to the alleged accused person it is totally depend upon the court and plea taken by the accused person. You can also put your fact before the court at the time of hearing bail.

Yes, SDJM has power to grant bail. As per code of criminal procedure case under section 420 of I.P.C. is cognizable offence and it is triable by magistrate of the First class as such SDJM has power and he can grant bail. you can oppose his bail application
