A woman was victim of domestic violence which resulted death, autopsy indicates death due to hanging, FIR was registered in june 2018 since then no arresting made, now accused files for anticipatory bail. How likely the accused will get the bail and if gets whats the way ahead to cancel the bail and course for punishment under 306.

Regarding your query granting of bail is the decreational power of the court but you can oppose or protest the bail with the help of your concerned Advocate. After that in trial you have to produce witnesses regarding your complainant filed.

Q: Husband of sister harassing her for money

Hi This is regarding my sister's marriage recently happened. Just after few days, we started getting trouble for dowry. here is what happened in short... Groom's proposal came through someone who was involved in a mission called Dahej Mukt Bharat and by photo and profile we liked. Just after engagement, groom's family asked for money and we hesitated but they started forcing else marriage will not happen. As engagement was already done, we did not want to stop marriage but hesitant to pay but at last by force we paid. After marriage, as soon as girl went to groom's house, they started torturing for things to get from our home and started asking for girl's money, what she is earning also. She is a teacher in home town. Boy started treating her badly, he started abusing by words and threatened for life and started talking everything against her family and so on many things... Should we go to police now or file a case in court?

Regarding your query first of all you can with the help of some respectable persons of both side of your society and arrange a joint meeting(panchity) to solve current situation and tell them about the misbehave, torture ing and dowry demand. If this is fail than without delay you have to go to your concerned police station for current situation.

Q: Fraud and harassment by sister and brother in law

after my father's Death my sister and brother-in-law took 15 lakh from my mother with fraud. and when the mother was unwell, she left her at my house. Now without any reason my brother-in-law calls me and makes filthy abuses. how do I take legal action?

Regarding your query you may file a complaint in police station or your district court with consent of your mother against your sister and brother-in-law describing all the fact done by aforesaid persons in your petition.

Q: False case filed on me by people of my village

I belong to a village. But now I am studying in a city in different ..one of the villagers file a case on me in fighting ... but I am not directly or indirectly involved in this case ...but he gave my name in FIR under the following sec. 341. 323. 379.307,107 etc ....how can I handle this case ..what will I do to easily release from this case because i am a student and I can't give my more time in court ,police station etc...it will disturb my study

Regarding your query you are a student and you are engaged in your study in city at the time of alleged occurrence. You have to meet with your concerned SP with a petition describing him your real fact in aforesaid case and also file a anticipatory bail petition as soon as possible.

i m a male and want to apply for divorce on curilty ground, two yr of marraige . no child, my wife in her parent home, already all secondry attempt done.. like panchyati, she is harrasing my family and my mother and making unnecessory and uneassy practice, first tym we ll make make a mutual aggremt and she accepted her all mistake and come to my home but again repeated the same,, pls suggest all positive and negative points for me and my family

Regarding your query your positive ground of cruelty is strong because you have already tried best to restore your marriage but unfortunately she not understand your family and continuing her misbehaving which comes into cruelty and negative point is that she can fie maintenance case but your previous Panchayati and mutual agreement will defend you from in future if she file other criminal case if any.
