An Insurance company changes the form originally filled.

An Insurance company changes the form originally filled by me, which I discover when I ask for a copy of the original form filled by me through email.The data originally filled are replaced (by a different handwriting).This they do probably because the underwriter rejected the form because of a disease mentioned there in, which would have meant they would have lost their commission. Probably they never thought that I would one day ask for a copy. Now I want to file a criminal case and seek damages.

In these circumstances you have an option to file both a civil suit for recovery in a competent court of civil jurisdiction and a criminal suit of cheating by virtue of filing a private complaint before the magistrate.

You also have an option to sue them in a consumer forum.

First, you should send a legal notice to the company seeking a public apology, original policy document and damages for cheating and criminal breach of trust.
Give them 15 days for the same and still if they dont agree as per your demands, file a case before the magistrate. Since, filing a police complaint against the insurance co. Being a co. Police will consider it as civil dispute and nit register F.I.R. However, it will beneficial for you to file a complaint directly to magistrate.

In addition to filling a criminal complaint. You can also consider filing a consumer complaint with the. District consumer forum/State Commision depending upon your claim amount.

I had similar Cases where insurance companies are acting fraudulently.

In addition to all this, you can also consider filing a complaint with the I r d a I which is the regulatory body for all insurance companies, and in case the insurance company is a p s u, you can also file a petition if your complaint is not addressed properly.
