Alimony and stridhan taken by family, how to file a case against them

I got divorced in 2017 Jan n my family has taken all my alimony and streedhan. Continously torture and harassed me. Even got molested by my cousin(tauji son) family knows about it. Cald on women helpline many times but of no use. M Indian. Wanted to know what to do in this case

In these type of cases u have to file a criminal complaint regards to the recovery of ur istridhan and other dowry articles.. Against them.. U/s 498a,406,323,506mipc to ur nearest police station.. With the help of an advocate..

You have to direct present before suppretendent of police (SP) , Give him written compliment and tell him about the all matter about your situation, quick action will be taken by suppretendent of police as well as written compliment also given at women cell.

You can file a criminal complaint for criminal breach of trust (406 IPC) against the family members and molestation IPC) against your cousin. The complaint has to be drafted properly and smartly, viz. the allegations must be specific enough. The police staff o not register case easily. So you required the services of a good and experienced lawyer.

Also you can file a civil suit for recovery of the Istridhan, but to get a suit successful, you require a good evidence.

the first step is to call Police Station or sent a letter to the police station and DSP, SP of your area. note keep the receipt of your post with you. if still, they are not taking any action then file a complaint before a magistrate of your area. you can take help of the lawyer in the drafting of complaint that is to be sent to police and that is to be filed before a magistrate. let me know if I can help you in any way.

file private complaint before magistrate under section 200 crpc against your family members. Before filing private complaint just try to Circulate the copy of complaint towards higher police officials like DCP or ACP which you already gave to police at their police station.
