Q: Legal consequences of buying a stolen phone unknowingly

I bought a Samsung note 4 last year and I did not know it was stolen until I got a call from crime branch haryana regarding this. The person from which I bought the phone gave me a bill also. It was a second hand phone. The day I got to know it is a stolen phone I sent back the phone to the police officer which called me on his address which he asked me to do. I also got to know whose phone it is and that person contacted me as well. I showed them the bill as I was not aware that i is a stolen phone. What should I do now. The phone has been taken by police. FIR under section 380 stands registered against unknown person. What should be my next step.

You need not worry since FIR is not registered against you. If the police officers try to harrass you or register fir against you at later stage. Than you can approach high court for quashing of fir and senior of that police officer in case of harrassment. You can never be imprisoned as you are bonafide purchaser



Q: What to do if Reliance ported my number without my permission

Hi, I am a Reliance GSM customer, since their operation is getting closed, we were issued PORT no. to compulsory migrate to other network. When I tried to PORT my number, I was unsuccessful with multiple operators. Later on, I noticed that somebody has ported my number to BSNL. This is only possible with involvement of company employees. Both the operators (BSNL, Reliance) have failed to follow due process of Porting, they have issued no. without verifying the owner of the number. On raising this to BSNL, they have suggested to lodge FIR to cyber crime cell. I wanted to lodge case against BSNL, Reliance communication and the person who is using my number. With my sources, I have the details of the person to whom my number has been issued. Please advise.

You need not worry about cyber cell and all that stuff. Just go to your local area and lodge police complaint or zero fir in that police station. Zero fir bounds police to send fir to appropriate police station or to cyber cell. You can also file civil case claiming damages from these companies or to get injunction for your mobile no.

sir, my car was hit by motorcyle inside residential colony and has been badly damaged. Bike as been damaged only to the extent of broken headlight. Biker was a minor. the biker has been admitted to the hospital with some injury. No fir has been lodged even after 48 hrs. police had asked me to go but have taken custody of the bike. now police is trying to make false case against me. plz advice what action should i take. pdsinha

But you can always write to concerned police station detailing about the incident.please note send the above writting by registered post and keep a copy for your record. This way police will become bound to take appropriate action in accordance with your letter.
