hello on 23 september 2023 i ordered oneplus 6 8gb 128gb in fair refurbished condition from well known brand cashify they mentioned that if any problem arise they will refund money but today on 26 September i received the package and for safe side i made video while unboxing the product and here i got scammed i got a dead device which is mentioned on their site that this problem comes under refund policy within 15 days and they are not picking my call i still have 13 days left
First of all rather than going legally you should serve them a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if they fail to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

yes you can file a complaint against them under section 12 of the consumer protection act but first of all you send a legal notice and claim your refund with interest as well as file a NCR report in the police station

Most of these companies have different levels of escalations.
In the past I have dealt with such matters. Usually they will not let the top management get to know about it and they will take months to resolve it at their end.
There are 13 days left, you can wait. Once the 13 days are complete - send a legal notice to them to comply with the terms and conditions.
