Wanto raise a complain on E-daakhil/ consumer court
27-Oct-2026 (In Consumer Court Law)
I am having Tata Tigor and on 23rd July due ot flood, it got damaged internally with water and external with dog and Monkey's run on roof and roof of car got damage. While submitting car, it was told to me to put in flood loss first and later in roof damage. After 2.5 months car serviced and returned. After checking rust is there, ants under seats, a lot of issues unresolved. so, I asked for such pending repairs and roof replacement. Car is with Tata service centre, insurance is of Tata.
Service-centre responsibility
Under Sections 2(11) and 2(42) of the Consumer Protection Act, 2019, inadequate or negligent performance of a paid service can constitute “deficiency.” The centre should complete the authorised work with reasonable care and in line with the job card and approved repair scope. Rust, ants, or other unresolved problems may support a complaint if evidence shows they were left unaddressed or arose or worsened while the car was in its custody. Consumer Protection Act, 2019
Flood and roof claims are distinct
The insurer’s obligation is governed by your policy, endorsements, exclusions, deductibles, survey findings, and proof of causation. Submit the flood-related water-ingress damage and the animal-related roof damage as separately itemised claims or claim components; ask for a written decision on each, identifying any policy clause relied on for a rejection. Roof replacement is not automatically covered merely because the flood claim was accepted. IRDAI Regulations
Document the present condition and demand a joint inspection
Photograph and video the car, including the roof, cabin, rust, ants, odometer, and warning lights. Obtain a defect-wise written status report and request a joint inspection with the service centre and insurer’s surveyor. Preserve the original and supplementary job cards, estimates, survey report, approvals, invoices, delivery note, claim correspondence, and proof of the car’s condition before and after workshop custody.
Send a formal written demand and escalate
Write to both the service centre and insurer, reserving your rights and stating that accepting custody does not mean the repairs are satisfactory. Request a rectification plan, completion date, separate written coverage decisions, and copies of the survey and repair approvals. If unresolved, use the insurer’s internal grievance process and then the applicable IRDAI grievance channel; retain acknowledgements and complaint numbers. IRDAI Regulations
