Gym refusing to accept cancellation of membership what can I do

I had joined a gym in Gurgaon which has a one month's notice cancellation clause. In mid February due to health issues I was unable to go to the gym and decided to discontinue membership. I wrote to them on 3rd March to cancel membership. The email bounced and they received it by 7th March a week late according to their clause. I have paid my monthly fees for February and March but they are insisting that I pay for April also which would amount to two months notice . I have refused to pay for April and they are saying that in that case they will refuse cancellation and are harassing me

Dear Sir, First we should send them a legal notice for the issue at hand and post that we can proceed to the requisite consumer forum. Though in the present scenario we may not have to go to the court and the Notice shall do the trick. for further assistance please contact us.

Even if they received the mail on 7th March and you have paid fees for the month of March, one month notice clause is satisfied. They are wrong in not cancelling the membership. You can send them a notice through a lawyer and if they do not oblige you can file case in Consumer Court claiming damages for harassment as well as cost of litigation.

Move an application to the concerned police station regarding the said issue and also move a complaint to health minister of haryana, along with that you have to move a complaibt to the central health minister and also move the said application at CM window.

The issue does not seem like one which cannot be sorted with dialogue. I highly recommend that you talk and appeal to their good senses to let it go. If you have proof of a the bounced mail that was sent in time, then do keep that. You must make sure that you send them a clear intimation in writing of your cancellation of membership and the date it is effective from. You may not take any legal action at the first instance but in case they do then it can be tackled accordingly. However I do not see them taking any action.
