Can I sue a hospital for causing mental harassment?

Hi, Our patient was admitted in hospital and we had a medical insurance and on discharge there was a refund and hospital told that in maximum 7 days we will get our refund via cheque and i constantly contacted them after 7 days and every time they made false excuses and asked for some more time and more than 1 month passed and i was harassed badly.I got refund after involving my friend who is in police. Can i take any legal action against hospital for such cruelty.Please advise.
You have eventually got the refund in few days after the intervwntion of your friend.The case would have been established if the refund was not given to you till date.Once you have got the refund there is no provision in law to file a case against the hospital now.

Yes you can sue the Hospital. You need to show the expenditure for each visit i.e. you might have used your own car or might have hired a taxi; you might have taken off from your work loss on that account. You can quantify all the expenditure as well as the mental harassment. I am sure you will get proper compensation.
Also you can write to the authorities concerned. Administrative measures taken by the government on Max Hospital is a good example.

For such harassment hospital is not responsible , your insurance company is liable and agent of such company or hospital staff who look for such proceeding is liable and you have to look is the dealing person in hospital send your case to insurance company timely ? Is insurance company did delay ? Find the actual accused and you can prosecute

Is delay in payment reality cruelty! Only u may ask for interest on late payment. Now when u got refund and want to file a case may be a cruelty to yourself. Do you think the court will hear u penalize to other in a week or in month. There are so important cases pending in courts, once think over it.
