Can I raise a case in Indian consumer court on international airlines on the event happened to me at Istanbul airport? I was supposed to fly from Mumbai to Amsterdam, but because of the denied boarding I couldn’t reach my final destination as planned. I can apply for a visa from the country which is either my first port of entry in this case Netherlands or the longest stay which in this case Poland and therefore, I had applied for my visa from Poland embassy. 1. My flight was from Mumbai to Amsterdam via Istanbul with Turkish Airlines 2. When I was boarding to flight Istanbul to Netherlands, airlines officials (who checks the boarding pass) told me that I could not board the flight because my visa was issued by Poland and I need to go to Poland first. They were denying the longest stay option of the visa. 3. I somehow managed to fly to Poland from Istanbul after lot of struggle at Istanbul airport and then to Amsterdam. 4. I got my luggage after almost three days of my flight

1st you need to get clarity from concern ambasy that whether you can go netherland without Visa, as you had visa of Poland and has to start your journey from there. Only after clarity you may choose to file consumer case or else you may lose your money and time in litigation, if your side is not proved correctly.

yes definately we can raise a case in consumer court india. however the jurisdiction will need to be decided. Also the documents that u have also will need to be looked at. However there is a time limit to approach consumer court. kindly approach quickly

In answer your question as partly yes. First of all you have to file consumer case for deficiency in services against the agency or company through which you processed your visa for boarding international flight from India. Second party will be the any international airline having branch office anywhere in India for deficiency in service and unfair trade practices. No you can not file a complaint against the carrier in India since as per the the incidence which you narrated the cause of action arose on Istanbul Airport where they denied for the reasons. Since the incidence took place at Istanbul you will have to file the case in Istanbul or of which county the ship is.

No in such case Indian Consumer Court does not have jurisdiction to entertain such complaint, moreover you will have to go through the terms and conditions mentioned in the particular Airline regarding jurisdiction to be entertain any dispute, if there is nothing mentioned about jurisdiction in that eventuality you may File case in civil court of the boarding city.

You can file complaint in the consumer court in Mumbai as your were denied boarding from Mumbai. Note that if the claim of compensation is less than 5 lakh you need to file complaint in District Consumer Forum, if more than 5 lakh and below 10 to the State Commission and if more than that to the National Tribunal.
