Builder is not paying back my money as I wish to cancel booking

I had booked a Villa (plot + house) with a builder 2 years back by paying booking amount. The land is registered but the building was supposed to be constructed. Now last year during Oct. I made the downpayment (20% i.e. 6 lacs ) towards the construction but the builder did not give me any documents like Construction Agreement or Receipt of the amount received. Upon insisting he sent email. However, on multiple follow ups he has only dug up my house and it's like that since 10 months and no development in the layout. Builder is not paying back my money as I wish to cancel.Please advise
You first approach builders t reg villa or else return the amount which u paid already along with interest.. he refused t pay issue one cause notice by Advocate against builders after that also he not respond.. file complaint against builder before consumer forum or file suit against builder in civil court..

You have no other option but to either settle with the builder or contest cases against him and teach him lesson ,but it will take a bit time and little harassment ,hence before much advicing it is also need to be seen whether you have good grounds to contest and teach him lessons or not .Mere filing a case I don't beleive in ,there are many recent good judgement has come in favor of client against such builder .Better contact our office .Adv pankaj Kumar

Dear Sir/Madam, you have every right to get your hard earned money, you have good case on merit, I assume that you have copy of booking Form at the time of booking the said villa and subsequent dates of emails you have, its sufficient for your case to take your money from the said builder. You have to issue a legal notice for cancellation and for refund of your money which you have paid as on today to them, if the said builder is not respond the legal notice, thereafter you have to file petition before district consumer forum for the same as well as compensation... if you want my legal service I will do it.
