Booked a studio apartment builder delayed possession for 5 years

I have booked a studio apartment with Logix Zest, Sec-143, Noida in Oct 2012.The possession date as per the buyer's agreement was 24 months.It is more than 5 years now and in the tower in which i have booked will take atleast 2 more years for completion. Request your valuable advise on the basis of above said. Regards,

Dear Concerned - Go ahead and file a complaint to UPRERA through its website - you will need to provide all the details of the project and your specific unit and once done you would need to specify your grievances. The Body will act on your grievances soon

In pursuance of the query posed, confined to the availability of limited available facts, it can be safely opined that deficiency of services has clearly been committed by the respective builder in the instant case. To put it in simpler terms, to avail a remedy thereto, a well drafted legal notice should be sent at your instance ASAP to the Builder, immediately followed by filing of a Consumer Complaint in the respective Consumer dispute redressal forum/Commission. (Depending upon the value of the subject matter involved)

There is a penalty clause in ur agreement which builder have to pay to buyers and now rera is applicable so u can file a complaint against builder in rera and if u don’t want to buy this apartment now than u can file consumer case aur case in permanent lok adaalat, rest of the matter can be discussed personally

I believe your value of goods would be under 1 crore so you can file a consumer complaint before State Consumer court at Lucknow or Delhi seeking refund of your money along with interest and compensation for delay in possession. Or you can create a group of people willing to take action against builder so you all can collectively file the consumer complaint before National consumer court at Delhi.
