Q: Delay in posession by builder in noida

Hello,I have booked a flat in noida on November 2019 and made all the payments including posession and maintenance charges by February 1st week 2020.I have been told that flat will be ready in 30-40 days after fit out work of plumbing, electrical and other repairing work.The flat is not yet completed and kind of frustrating. I am paying EMI monthly to bank without even getting flat.If I skip the lockdown period, the work resumed in june and it is October end. Can I claim for interest on delay ?

Except lockdown period , you will get the delay penalty only if you go to RERA, however we will suggest that speak to the developer and take the possession ASAP and do not get into litigation for 50-1 lac , hence pls avoid uncessary litigation and if required file RERA through your counsel

Q: Gift with new broadband connection is not fulfilled by company

Tatasky broadband company has promised me to give firestick free of cost along with tatasky broadband connection. I have done many followups with the company but still no resolution. I would like to take legal action against the company. Please advise.

if you have this in writing that they were supposed to give you fire stick and have not given you in that case you should start a legal battle with them you should send a legal notice asking for the firestick only after that you can file a consumer case

मेरे परदादाजी (मेरे दादाजी के पिताजी) का वर्ष 1940-1950 का एक मकान है। उनके केवल दो बेटे थे। बड़े बेटे वकील और छोटे आगरा विश्वविद्यालय में डिप्टी लाइब्रेरियन के पद पर थे। छोटे बेटे अत्यंत सीधे थे ये बात पूरा विश्वविद्यालय और सभी पडोसी जानते हैं। बड़े ने छोटे को बोला घर का आगे वाला भाग में मेरा परिवार रह लेगा और पीछे तुम अपने परिवार के साथ रह लेना। क्योंकि मेरे दादाजी किसी तरह का लड़ाई झगड़ा नहीं चाहते थे तो मौखिक स्वीकृति देकर रहने लगे। घर का कोई कानूनी तौर पर बँटवारा नहीं हुआ है। लेकिन अब मकान जर्ज़र होने लगा है। और जब हमारे दादाजी के पक्ष के लोग बड़े दादाजी के पक्ष के लोगों से, जो कि बाहर के हिस्से में रहते हैं, मकान बेचने या कानूनी तौर पर बंटवारा करने का बोलते हैं तो वो दोनों में से किसी भी बात पर तैयार नहीं उल्टा ये बोलते हैं कि तुम अपना हिस्सा बेच दो। यह कैसे संभव है बिना कानूनी बंटवारे के?प्रश्न यह है कि कैसे कानूनी तौर पर बंटवारा किया जाए? क्यों वो ऐसा बोल रहे हैं कि अपना हिस्सा बेच दो जबकि कोई कानूनी बंटवारा अब तक हुआ ही नहीं है। ऐसी संपत्ति का आगे क्या होगा?

Q: Domestic violence,applied mutual divorce 10mnths back,had to withdraw

Hi there, I have questions regarding this case of DV...1. My husband is dominating me for earn money for my own, also he use to abuse everyday, trying to prove me charachterless, he abuses in front of my child of 3&half yr old, he wanted me to leave the house too, he tried to involve me with his cousin brother for getting intimate with him, when I oppose, he himself putting many allegations upon me, I'm in stress. Not only this, he just want to use me for making money, whatever I earned till the date, he has taken from me. Also the money he borrowed from me sometimes, not ready to giving me back now, everyday he is forcing me either to earn on my own or beg from him, he mentioned me all he is doing for the money, he wants to sell his house,, & leave me bankrupt. Also he never wanted a girl child, I fought for her education, then only he got ready to pay her school fees, He doesn't want to carry any responsibility, & so I get ready for mutual divorce, but then I had to withdraw.

in the present situation the first thing you need to take care of is that under any circumstances do not leave the company of your husband that means do not leave house where you are staying right now . you may choose to file complaint under Domestic Violence Act

Q: Lawyer not appearing in the court for hearings

Dear Sir, We have a disputed property case and we are on the verge of winning it but the other party Lawyer has submitted his medical report from last one year and is not appearing in the court as he know he will loose the case and this way he can delay the judgement.What should we do and for how long do I need to wait for the lawyer to recover?PLease suggest

Dear concernedUnder such circumstances fil am application to proceed to xparte in the case . You lawyer as well seem to be not working towards finishing of the case or else could have filed application after 3-4 dates itself. Best of luck
