Bank not providing original list of documents

I am planning to transfer my existing home loan to another bank. For which the new bank required a document "list of documents" from previous bank. This "list of documents" is the list of original papers which are presently in custody of previous bank. I request the pervious bank for this document. The previous bank took my request and also provide me SR number. They also charged me for this service. The TAT for this request was 15 working days. Now more than 30 working days have past and the bank is not responding back. I have written mail till their head of india customer support but no response yet. Would moving to consumer court would an appropriate step, moving forward? Are the consumer's courts open now a days?

Hello, Sir, I suggest that you should first of all issue legal notice to the bank and if incase the bank gives your documents then the query gets resolved. If incase the bank does not return the documents then you may initiate with suit for mandatory injunction. For more information feel free to have a word with me.

Yes. Consumer Courts are working nowdays through Video Conferencing hearings. This is a case of deficiency in services on the part of the service provider and falls well within the ambit of consumer protection act. You have an option to file a suit for mandatory injuction aswell

If the fee for any services has been charged from you and have not been given yet, you can surely move to consumer forum. However in your case sending a legal notice would be required as this does not involve any dispute of facts as the bank itself has agreed to furnish the list of documents and charged for the same. However if after sending a legal notice the bank does not provide the same, then moving to the consumer forum would be the next resort.
