Which of the two nominees will get the first preference

My mother sister - Aunt (Widow) died in sep-17, no children kept me as a nominee but same name exists with my uncle(aunt husband who died in 2014) brother son (50yrs) , so as per law who will get first preference

Along with nominee name they will ask relation with nominee and age of nominee. The person who matches with their records , they will get benefits. Certain cases surname changes. So consifering all facts.

Nominee is only the trustee and not a legal heir. Nominee is like a manager who is to take responsibility of the money and handover the money to the legal heir who are eligible in accordance to succession laws.
So the assets will be distributed in accordance to prevailing succession laws.
For succession laws in india are in accordance to your religion and we have separate laws for hindu's , muslim's and christians.
So we need to know your religion to advise on preferences.

As per law, who ever approaches the court of law and obtains the legal heirship or certificate for claims, it is not sufficient to get nominated or nominee, as being nominee itself will not suffice to make a claim
