Hi,
you can certainly get the father's share in the property and make a simple application to the Tehsildar of concerned Revenue Village with fathers Death Certificate and your relationship documents to get the name change process completed. You don't need your Uncle's consent for it.
You may also send across a notice to the Tehsildar, Tualatin and Collector informing them about the fraud your Uncle is playing upon you.
You may apply for Legal Heirship and seek Partition of the property. After filing the Partition suit, you may seek an injunction on the said property, to ensure your Uncle doesn't deal with the said property.
You need to prove that the property in the name of your brother was purchased from the money that came from the ancestral property. At the time of purchase of that property your brother was not in a position to purchase it all by himself. For urgency you can send legal notice through a lawyer to your brother asking him to stop creating any encumbrance over the property. Then you can file a civil suit for injunction.
