Property dispute between brothers

My dad files a suit against my real uncle for a property which is alloted to my father for dairy farming but from starting my uncles residing on it since it alloted in 1976 but my dad lawyer miss guide him and he files suit in 2014 and his Everment in suit is that till 2006 we are in pojjesion and running business over the suit property after that in 2006 he call his brother to manage business and we hand over the property to them but this is false we are residing some other place we were never been in pojjesion and my uncles everment in suit is that they are in unitrepted pojjesions since 1976 and they file proof of that like ration card id school Certificate and many others deffendents are saying they are owner off suit property by the vertue of oral family satelment and they are saying they have witness of that and file so many wetness name we succeed to stop them to construct house or billding over suit property now matter is listed for evidence Can my suit service ..

Before advising on the merits of the matter, it is necessary to go through the suit filed, the written statement filed by your real uncle, the witness produced, the evidence and other documents placed on record.

As per details given by you, your father is the joint- owner of the said property and has 50% share in it. your father or you may on behalf of your father ask for division the property and if your uncle does not agree for it , civil suit can be filed in the concerned court.

Hi, you can certainly get the father's share in the property and make a simple application to the Tehsildar of concerned Revenue Village with fathers Death Certificate and your relationship documents to get the name change process completed. You don't need your Uncle's consent for it. You may also send across a notice to the Tehsildar, Tualatin and Collector informing them about the fraud your Uncle is playing upon you. You may apply for Legal Heirship and seek Partition of the property. After filing the Partition suit, you may seek an injunction on the said property, to ensure your Uncle doesn't deal with the said property.

You need to prove that the property in the name of your brother was purchased from the money that came from the ancestral property. At the time of purchase of that property your brother was not in a position to purchase it all by himself. For urgency you can send legal notice through a lawyer to your brother asking him to stop creating any encumbrance over the property. Then you can file a civil suit for injunction.
