How to claim Maintenance from ex army service's man

Sir, There is a wife and two minor daughters of ex army person. The wife of ex army person residing separately with her two minor daughters since her marriage on rent. Minor daughters are doing their studies in 9 and 8 classes. But ex army person clear denied to give any kind of maintenance to her wife and daughters. So, can they are entitled to maintenance from her father/ husband and they have any right on such kind of amount which he got on retirement or pension salary. Sir please help and reply to us. This is a question for some needy person.

Absolutely!
Ex-serviceman's wife and children also have all the rights to claim maintenance from him. Its his duty to maintain them. You should immediately file a petition claiming maintenance from him on behalf of wife as well as children.

File maintainance case against him if he denies to provide you maintaince then after six month file execution and Give his pension account to court and then court will attach his pension account and you will get 1/3 of his pension amount for yourself and extra maintainace amount for your minor daughters

Go for a Petition under section 125 Crpc, court will order your husband to provide maintenance to you and your minor kids.The maintenance ammount can be recovered by attaching the sallery or pension of your husband, court may also send him in jail if he fails to obey the order of court.

You have right to claim maintenance from your husband in 125 crpc .even you can file domestic violence case in which you get maintenance .if he refused to give maintenance then you have right to attach his salary
