How can i Appeal in HC for a case against BSES Rajdhani

01-Dec-2023 (In Civil Law)
Due to some mistakes by my learned counsel, I mistakenly went the Permanent Lok Adalat to fight a case against BSES Rajdhani. Instead of being able to fight the case on its merits, I was forced into a settlement which I didn't want. How do I appeal to the Higher Court? In case an appeal is not possible, what other legal recourse is available?

Has the settlement of the lok adalat been recorded. If yes then it would be difficult to back out of the same however it can still be contested although its to the discretion of the court if it wants to allow the settlement to be buried.

hi you can file an article 226/227 petition the Delhi HIGH COURT against the said order stating how this order has been forced upon you when you were not willing to settle the matter. Also you present before the Delhi high court yours facts which were not stated before the lower court.

I would like to clear that the matter is sent to the Lok Adalat with consent of both party. After deciding the matter, you want to withdraw, now you have to follow the legal p[occurred and matter will reopen in the same court.

Unfortunately after settlement, no other remedies exist. Your advocate should have been informed you that lok adalat is for mediation and not for adjudication. If you have signed on any settlement, no appeal lies.

Dear Sir/Mam,

Firstly, we need to know how have you been wronged by BSES Rajdhani. Secondly, we need to look at the terms of settlement.
Be that as it may, subject to review of the documents, you can approach the Court and challenge the settlement on the grounds that would be culled out from your documents.

Thanks and Regards
