Father made gift deed to my brother and he died what to do

M muslim Sunni my father gift deed to my brother without my knowledge 13acrs land in 2002 and he passed in 2014 I know after his death mother still live the land is my grandfather . So what we should do me mum n sis r all one side. So plz suggest what I do.

Immediately file for your share of property in the jurisdictional Court, along with a affidavit showing your family tree ( Genealogical Tree) starting from your father. The source of the property is not relevant.
Your brother will get only one third share , provided he proves the will as genuine and legal.
You will get your share in the rest two thirds of the property.
In case your brother is not able to prove the will you will get more.

There is no restriction under Mohammedan Law regarding transfer of property. Though it is your grand father's property once it comes under your father's possession he can use as per his wish which you cannot question. But still you can contact with your documents for finding better solution if any.
The first thing is this is u r father own earning property r ansitral property if his own earning property u don't hv any rights on that part,r is that ansitral property he don't have any rights to gifts without u r permition .and one more thing without verify u r all dacuments I con't tell anything so that's why visit our office at once will explain. As per Mohammedian law the father gifted to ur brother you can not challenge it after demice of your brother that propery goes to his wife and children. If there are no wife and children then only you can become one of the person to claim his property as next legal heir.
