Cancelled the booking of a property but not getting refund of deposit

I have booked one property by paying some initial deposit amount and now i am cancelling that property , as broker says to cut the amount and refund my deposit but we had done done any paper work so it is legal to cut the amount and refund me money back. please help me
in case you have already cancelled the booking of property and looking for refund and no paper is available to protect your rights. in case the amount is huge and the broker is asking for his cut its better to take the deal else your amount would remain stuck and you will go on to spend more in case of filing any cases
