Can I get custody of my Son who is living with his grand parents ?

27-Dec-2023 (In Child Custody Law)
I am a Christian and I had a divorce 2 years back. It was a mutual consent divorce. I have 3 points to discuss. 1. I gave custody of my son to my ex on the grounds that I can meet my son anytime I wish to. Now my son stays with his mother's parents. Can I take the custody of my son on the grounds that my ex is not able to keep my son along with her and hence she moved him to his grand parents. 2. While on divorce papers it's mentioned that I have to pay 2000Rs as maintenance every month I had categorically told her that I won't be paying that amount and strike that clause from the agreement. She said it's okay that I don't pay the amount but if we change the document then the divorce will take more time hence leave it. I want maintenance clause to be striked out of the agreement.. 3. Whenever I have to meet my kid I have to pick and drop him all the time my ex never drops him at my place.

Hi,
You have read and after understanding the agreement you have signed now you want some of the clause to be changed it will be possible only if both of you again agreed to rectify the same. Did you not mentioned that you have to pick and drop the child, then for this also you have to talk with her only. For visitation rights you have to approach the court and file a case then it depends weekly once or montlhy .
