What to do if the time to file an NI case is over

my chq was bounced on 8 jan 2018 as per bank statement , but still i have not recd payment, 30 days limit to initiate legal action is expired, any remedy available now or not ?

You have to file civil case on the basis of cheque under order 37 for recovery of dues or file a crimal case under 420 for the same this is the solution of your case. Kindly consult bas soon as possible.

Firstly contact your bank and get the cheque along with the return memo.
You can then file a summary suit which ian effective legal remedy to recover your cheque amount. The right way is to issue a legal notice for recovery of the cheque amount and after elapse of 15 days, file a summary suit in the appropriate court.

after bounce of the cheque we have to send legal action within 30 days but if we did not do so then we can’t file any criminal case.
But we have file a civil suit against that to get whole amount with interest and court processing fees and expenses.

Hello client hru.
As per ur question ur time for legal action got lapse and now u have two remedies either to file a civil suit in civil court or u can extend the limit of the cheque so u can take action as per night N I 138 .thanks.

The validity of the cheque is 3 months...you can deposit the cheque as many time as you want and your period of filing complaint under NI Act will start from the last memo.
The other remedy available with you is filing a civil suit for recovery.
You can also pursue criminal remedy and file a complaint for fraud, misrepresentation and cheating.
I have done these cases and they actually are very effective and facilitate recovery of money.
